A Weyburn man facing a number of child pornography charges appeared by video from the Regina Correctional Centre in Weyburn Provincial Court on Tuesday, May 30th.

The court proceeded with a show cause hearing, which is where the Judge decides if the accused will remain in custody or be let out of custody before their trial.

The Crown stated that they were opposed to the release of the accused based on his lengthy criminal record, likelihood to reoffend, and outstanding allegations still before the court.

The Crown stated that this was a reverse onus situation, where the burden of proof is on the accused to prove or disprove the elements of the offence.

Defence counsel requested a publication ban under Section 517 of the Criminal Code, for all submissions in court. A publication ban is a court order which prevents anyone from publishing, broadcasting or sending any information that could identify a victim, witness, or other criminal justice system participant.

Defence counsel suggested stricter conditions for the accused and said that the accused was prepared to consent to the conditions.

The Judge said that the court has concerns for public safety, the Crown has a relatively strong case, and there is a high likelihood of jail time for the accused.

Based on the totality of the circumstances, the Judge remanded the accused in custody until his next court date, which was adjourned to July 4th, 2023 at 9:30 a.m. at Weyburn Provincial Court.

Another one of the accused's matters was adjourned to August 10th, 2023 at Weyburn Provincial Court.
