The Weyburn Police Service were dispatched to a report of a two-vehicle collision on Coteau Avenue at 5th Street NE last week. There were no injuries.

This collision has led to the WPS to remind drivers on the correct way to use an intersection controlled by a four-way stop. While it is common practice that the person who stops first gets to go first, legally speaking the Law is that you must yield the right of way to the driver on the right.

If two vehicles come to the intersection at the same time, the vehicle on the right has the lawful right of way.

In the event of a collision, the driver to the left could be at fault even if they stopped first.

SGI says that all drivers have a moral and legal responsibility to avoid collisions. You may have the right of way at an intersection but if a driver refuses to yield to you, you're responsible from a safety standpoint to avoid a collision, rather than insist upon your right of way.
